  • Informal Resolution: Before filing a claim against Static Control, you agree to try to resolve the dispute informally by contacting us at the address provided in Section 9. We will try to resolve the dispute informally by contacting you via email. If a dispute is not resolved within thirty (30) days of submission, you or Static Control may bring a formal proceeding.

  • Binding Arbitration: Any dispute, controversy, or claim arising out of or relating to these Terms of Use or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by arbitration in Sanford, North Carolina, before a single arbitrator. The arbitration shall be administered by the American Arbitration Association ("AAA") in accordance with its Commercial Arbitration Rules and the laws of the State of North Carolina. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

  • Class Action Waiver: YOU AND STATIC CONTROL AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. Unless both you and Static Control agree otherwise, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.

  • Exceptions: Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

1.15 Limitation on Time to File Claims

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR THE WEBSITE MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES; OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.

  • Policies and Procedures: We revised existing data protection policies and procedures to meet the requirements and standards of the GDPR, UK GDPR, and any relevant data protection laws, including:

  • Data Protection: Our main policy and procedure document for data protection has been overhauled to meet the standards and requirements of the GDPR and UK GDPR. Accountability and governance measures are in place to ensure that we understand and adequately disseminate and evidence our obligations and responsibilities, with a dedicated focus on privacy by design and the rights of individuals.

  • Data Retention and Erasure: We have updated our retention policy and schedule to ensure that we meet the "data minimisation" and "storage limitation" principles and that personal information is stored, archived, and destroyed compliantly and ethically. We have dedicated erasure procedures in place to meet the "Right to Erasure" obligation and are aware of when this and other data subject rights apply, along with any exemptions, response timeframes, and notification responsibilities.

  • Data Breaches: Our breach procedures ensure that we have safeguards and measures in place to identify, assess, investigate, and report any personal data breach at the earliest possible time. Our procedures are robust and have been disseminated to all employees, making them aware of the reporting lines and steps to follow.

  • International Data Transfers and Third-Party Disclosures: In cases where we may store or transfer personal information outside the EEA or UK, we have robust procedures and safeguarding measures in place to secure, encrypt, and maintain the integrity of the data. Our procedures include a continual review of the countries with sufficient adequacy decisions, as well as provisions for binding corporate rules, standard data protection clauses, or approved codes of conduct for those countries without. We carry out strict due diligence checks with all recipients of personal data to assess and verify that they have appropriate safeguards in place to protect the information, ensure enforceable data subject rights, and have effective legal remedies for data subjects where applicable.

  • Subject Access Requests (SAR): We have revised our SAR procedures to accommodate the 30-day timeframe for providing the requested information and for making this provision free of charge. Our procedures detail how to verify the data subject, what steps to take for processing an access request, what exemptions apply, and a suite of response templates to ensure that communications with data subjects are compliant, consistent, and adequate. For more complex requests, we reserve the right to extend the response time by a further two months in accordance with the GDPR and UK GDPR.

  • Legal Basis for Processing: We review all processing activities to identify the legal basis for processing and ensure that each basis is appropriate for the activity it relates to. Where applicable, we also maintain records of our processing activities, ensuring that our obligations under Article 30 of the GDPR and UK GDPR are met.

  • Privacy Notice/Policy: We have revised our Privacy Notice(s) to comply with the GDPR and UK GDPR, ensuring that all individuals whose personal information we process have been informed of why we need it, how it is used, what their rights are, who the information is disclosed to, and what safeguarding measures are in place to protect their information.

  • Obtaining Consent: We have revised our consent mechanisms for obtaining personal data, ensuring that individuals understand what they are providing, why and how we use it, and giving clear, defined ways to consent to us processing their information. We have developed stringent processes for recording consent, making sure that we can evidence an affirmative opt-in, along with time and date records, and an easy to see and access way to withdraw consent at any time.

  • Processor Agreements: Where we use any third-party to process personal information on our behalf (i.e., Payroll, Recruitment, Hosting, etc.), we have drafted compliant Processor Agreements and due diligence procedures for ensuring that they (as well as we) meet and understand their/our GDPR and UK GDPR obligations. These measures include initial and ongoing reviews of the service provided, the necessity of the processing activity, the technical and organisational measures in place, and compliance with the GDPR and UK GDPR.

7. PRODUCT WARRANTY

7.1 Warranty Periods

  • Ink Jet Cartridges: 24 months from the manufacturing date

  • Toner Cartridges: 36 months from the manufacturing date

  • All Other Products: 12 months from the date of purchase

 

7.2 Warranty Coverage

Static Control guarantees our cartridges will be defect-free in both workmanship and materials for two years from the date of manufacture for our ink jet cartridges and three years for our laser cartridges. At our discretion, we will replace or refund the full price of the cartridge should you find it performs unsatisfactorily.

 

Our cartridges are also guaranteed not to cause damage or abnormal wear in any printer for which the cartridge was originally designed and covers all equipment used within the manufacturer's specifications. This does not include natural disasters or acts of God.

 

7.3 Printer Damage Coverage

We will reimburse you for a complete repair should a defect in a Static Control cartridge be found to be the sole cause of damage to any printer. Static Control must be provided satisfactory evidence that printer damage was caused due to a defect in a Static Control cartridge.

 

7.4 Warranty Claims

All claims must be accompanied by an invoice from the designated authorized service company and the invoice must clearly indicate repair specifics, along with the contact information of the dispatched field service technician. Return of the defective product is required and must be clearly marked with an official Static Control-issued RMA on the outside of the package. Any sign of tampering with the product by non-Static Control personnel will void this warranty.

 

7.5 Limitation of Liability

Static Control's liability shall be limited to repair, replacement, or reimbursement. This warranty is exclusive and in lieu of any and all other warranties, expressed or implied. This warranty is subject to change without notice.

8. MODERN SLAVERY ACT STATEMENTS

 

8.1 Anti-Slavery and Human Trafficking Policy of Static Control Components (Europe) Ltd

This policy statement is made pursuant to Section 54(1) of the Modern Slavery Act of 2015 (UK) ("the Act") which requires companies doing business in the United Kingdom to disclose information regarding their policies to ensure there is no slavery and human trafficking within their organizations or in their supply chains. This is our slavery and human trafficking statement for the year ending December 31, 2025.

 

Our Organization: Static Control Components (Europe) Ltd. manufactures and sells imaging products (components and supplies used in imaging forming apparatuses such as printers, copiers, facsimile machines, and multi-function devices) on a world-wide basis.

 

Policy Statement: Modern Slavery (such as forced labor, child labor, debt bondage, and sexual exploitation) and Human Trafficking (people being sold as a commodity) are completely incompatible with Static Control's commitment to act lawfully, ethically, and with integrity in all of our business dealings. Static Control opposes any deprivation of a person's liberty in order to exploit that person for personal or commercial gain.

 

We are committed to ensuring that there is no modern slavery or human trafficking in any part of our business. We expect our suppliers and business partners to share this same commitment. Our Organization: Static Control Components Inc. manufactures and sells imaging products (components and supplies used in imaging forming apparatuses such as printers, copiers, facsimile machines, and multi-function devices) on a world-wide basis. Static Control has business divisions in the United States and Canada.

Policy Statement: Modern Slavery (such as forced labor, child labor, debt bondage, and sexual exploitation) and Human Trafficking (people being sold as a commodity) are completely incompatible with Static Control's commitment to act lawfully, ethically, and with integrity in all of our business dealings. Static Control opposes any deprivation of a person's liberty in order to exploit that person for personal or commercial gain.

 

We are committed to ensuring that there is no modern slavery or human trafficking in any part of our business. We expect our suppliers and business partners to share this same commitment. If we determine that one of our suppliers or business partners is involved in slavery or human trafficking, we will move swiftly to terminate our relationship with the offender.

 

Compliance: Static Control has no reason to believe that any slavery or human trafficking exists within any of its business divisions. Static Control will take the following steps to ensure that this continues to be the case:

  • Communicate our policy on modern slavery and human trafficking to all employees.

  • Provide training to our employees regarding the issues of slavery and human trafficking. The training will include how to identify slavery and human trafficking and to report suspicions to management.

  • Regularly review our internal labor practices (such as the recruitment of temporary employees) to ensure compliance with our policy.

  • Employees will be encouraged to raise concerns about suspicions of slavery or human trafficking with regard to any entity with which we do business.

  • Communicate our policy on modern slavery and human trafficking to all our business partners and suppliers.

  • Refuse to do business with any entity we find to be knowingly involved in slavery or human trafficking.

 

Further Steps: We will continually review the effectiveness of our policy to ensure there is no slavery or human trafficking within our business or in our supply chains. To further improve our policy regarding slavery and human trafficking, we will refer directly to the provisions of the Act to ensure complete compliance.

 

Responsibility: Our Senior Management is responsible for ensuring Static Control's compliance with the Act.​
